cd crack

Few days ago, when I was reinstalling
MS-Office 2000 on one of our pc's. I use only authorised
programs and CD's so it was genuine Microsoft CD with all
required licenses.
And this CD cracked in my CD-ROM. I have lost CD and CD-ROM
at once.
I'm only person that takes care of all program CD's, so I
am sure, that this CD was never falled down or knocked, so
any physical defects are excluded.
The one-year guarantee for my CD-ROM given us by seller
expires in September, but when I contacted the seller, they
informed me that there is no guarantee in such cases.
I, as experienced pc products consumer think that it's not
fair. So I ask you for assistance in this matter and your
opinion, which side- me or the seller is right.

Well, the disk can be replaced, I can't comment the drive.
