Custom list as a data retrieval service

I have created a custom list in a site. I want to use this
list as a data retrieval service. But this list is not
visible when I try to browse to use it through a pivot
chart webpart. If I create this in a top level area(like
News) the list is visible. Is there a way to make it
visible if I create it in a site
