drop-down list box validation fails after initial selection

I've got a web enabled infopath 2007 form with MOSS.

This form has a drop-down list box and a file attachment control (the
file attachment is in a repeating table, but the drop-down is NOT in
the repeating table).

I've added validation to the drop-down list box that says "If any
occurance of the file attachment control is not blank". As soon as I
upload a file, the validation kicks in and the red-dashed border
apperars around the drop-down list box. So far so good. Now, if I
choose a non-default ( but valid) option in the drop-down list box and
THEN select the default (not valid) option the red-dashed border
disapears. The validation still kinda works though. When I try to
submit after following the steps above, I get the standard "The form
cannot be submitted..." validation message along with this additional
text:
"Field or group: my:fac_requested_approver
Error: Facilities Acknowledgement required" and does not submit the
form. Also, at this point the red-dashed borders come back.

The validation message is referring to the correct fields.

I tried this same process when the validation is NOT pointing to a
file attachment control and when I chose the devault (not valid)
option in the drop-down list box the red-dashed border came right
back, as expected.

Any ideas? Got a better suggestion as to how to check and see if a
file has been attached to the form?
