Excel 2007 conditional format and merge cells

I have a worksheet with conditional format for all cells (2 rules).

When I look in "regels beheren" (managing rules?) in the box "van toepassing
op" (applies to?) it says "=$1:$1048576", this means it wil work on every row
(I hope I translated it good from Dutch to English).

So far no problem, but I have to merge cells and undo that frequently, (I
know that merging cells in Excel is asking for trouble, but I see no other
solution for the task which I use this spreadsheet for).

When I make 3 merge actions and look at the "applies to box" for the
conditional format it says:
=$GB$1:$GF$7;$GB$9:$GD$10;$A:$FX;$FY$1:$GA$10;$FY$12:$GC$1048576;$GD$12:$GD$13;$GE$9:$GF$13;$GJ:$XFD;$GG$1:$GI$13;$GD$15:$GI$1048576;$FY$8:$GG$8;$FW$11:$GH$11;$GB$14:$GJ$14

I think when the users make >20 merge actions I'm heading for problems.

So for I tried:
- with and without $
- selecting all rows or all columns
But no luck.

I also tried to make a macro which on a event (calculate) will reset the
"applies to" . But I can't find the "applies to" settings for the object
"conditional format rule". And when I record a macro when resetting the
"applies to box" it will delete all conditional format rules and build them
up again. This works but will freeze the screen for 10 seconds, this is not
working when it happens every time calculation takes place. Letting it happen
when the user merge a cell is also to frustrating.

Has anyone a solution or a direction
