fishy ebay items

I have recently purchased a student edition office 2003
and have noticed a flood of them on ebay, all with upc
information removed for rebate puposes (has microsoft ever
offered a rebate?). Are these stolen copies or in some
way illegal? This seems fishy to me. What is the story
here?

Microsoft does not prohibit legitimate owners from reselling their retail
copies of software. To protect customes from possible fraud, listings on
eBay are normally reviewed by the Microsoft VeRO team to be sure the package
offered is complete and eligible for sale. That means that you must get the
box with the Certificate of Authenticity hologram on the side, the End User
License Agreement, an original CD, and any user documentation that came with
the software. If you got all that, you should be fine. You can also call
1-800-R-U- LEGIT to verify that the CD and key that your received is
genuine.

If it turns out that that you paid for a counterfeit copy, you should file a
fraud alert with eBay. If you paid for the software via a credit card,
dispute the charge. If you paid with a money order or an eCheck, file a
fraud protection claim with ebay.

Per the EULA, it cannot be transferred to a third party. I take it to mean
that it cannot be re-sold. See section 13:

"Transfer" refers to a copy that has already been installed on a machine.
That's a different scenario from reselling an unused copy.

If resale itself was not permitted, the listing would have been caught by
the VeRO program.

For what its worth, I'm pretty sure there are still quite a few invalid
sales taking place on EBay.
