graphics legends move around even when locked via properties

When the data changes and the graphic is displayed, the legend at the bottom
creeps upwards into the gragh itself.

I have tried everything including right clicking gragh selecting "format
chart area"
selecting "properties" and selecting "move but don't size with cell"

how can I stop this legend from creeping around?
Also in new graphs there is a "lock graph option" but this option does not
appear?
