I began working at KFC in may of 1984.i was employed for a total of 25 years
i worked in a management position for 24 of the 25 years.
On february 17th of 2009 i got a new boss jeanette alcala.on march 7th 2009
I suffered an on the job work injury.I suffered 1st & 2nd degree burns to
the face and chest.There was alot of pain oozing blisters and scars.
I returned to work on march 17th.Prior to my return on march 14th I had a
very disturbing phone call with Mrs Alcala.Iwas talking with her ab out the
next weeks schedule.Mrs Alcala was very angry about the way the store was
running in my abscence.I told her that I was sorry that i was out of work
but there was nothing i could do.She told me "Im not here to do your job for
you and im not going to run your store for you"I felt pressured and fear and
returned to work on the 17th of march.I still had open wounds and blisters
on my chest.
I had a doctors note stating icould not be around heat or prpare foods.My
location at 3005 highland is a particulary small and made it very difficult
no accomadations were made by KFC to fullfill the work restriction.In fact
on at least 3 occasions during Mrs. Alcala's routine visits I was on a cash
register due to labor restraints (manpower labor $) she questioned why i
told her remember i have my doctors note she would roll her eyes and use
negativ e body language.
On march 27th 10 days after my return I recieved I was given an action
plan.Mainly about leading my team and holding my team accountable.On april
21st I recieved another action plan to clarify the initial and to add more
stipulations not previously stated.
On one of these visits Mrs alcala made some disturbing improper
comments.Note icould not yet wear a bra at the time due to the oozing
blisters.Quote" no wonder your team looks the way they do look at you"I told
her due to my large size i could not wear the button up shirts most managers
wore so i the totally acceptable polo with the KFC logo again she looked
displeased.
At the time of the 1st action plan I feel I was succesfully running a 1.2
million$ operation.
BSC=3.35 in house overall rating 1-5 3 being on target
CFF=73 in house strct food safety inspection well within average score
nationwide.
A=San Diego health dept rating.
I feel that my initial action plan up yo and including my termination on may
19th was retaliation in direct response to my on the job work injury and
wormans comp filing.
I served KFC dilligintly and proudly for 25years only to be wrongfully
terminated in the end.
