I have preselected a layer and marked the layer as visible and active. I drap
and drop a shape from the shape bar onto the layer. The shape does not belong
to the preselected active layer but rather to a visio default 'flowchart'
layer that seems to be created at that instant.

I define the layer for the shape and then remove 'flowchart' from the layer
properties. I drag and drop another shape and the 'flowchart' layer is
created again with the new shape belonging to this layer.

I can't seem to create a new shape that defaults to my selected active layer.

Any idea's as to why this happens and how I can create shapes for the
current active layer ?

I would suspect the reason for the shape showing up on the flowchart level
is that the master shape in the stencil you are using has it as the default.
Try editing the shape on the stencil before dropping it.
