License question

I have upgraded from Office X to Office 2004.

Without reading through all the legalese, I need to find out if I can
transfer the old Office X to another person. In other words, can I remove
Office X from my Mac, give the CD to someone else and let him install and
register it?

Yes you can. There is no activation for Office X. Just give the person the
box, cds and the key. Its fine.

EAK may be right as far as physical transfer, but I wouldn't rely on
EAK's legal advice.

According to the Office 2004 license (EULA, section 12.1), in order to
use the upgrade product, you need to be properly licensed to use the
product that the upgrade is based on. Therefore if you transfer Office
v.X, you're legally giving up your right to use Office 2004.

The person you transfer to will be OK, but if you're ever challenged,
you'd be required to show that you own a currently licensed version of
Office v.X

One caveat - if you have a full previous version that is eligible for an
upgrade to Office 2004 (e.g., Office 98 or 2001), you can transfer your
copy of v.X, but if it's an upgrade copy, the transferee will have to
have a version eligible for an upgrade to be legal.

If you ever need to reinstall Office 2004, and it's an upgrade copy, won't
you need the Office X CD to show the installer that you have the version the
upgrade is based on?

I expect so, unless one has an earlier version's CD, which can also be
used to verify the upgrade.

I have a full version, however, so can't test that.
