office 2000 pro licensing issues

LuDean Marvin

I recently bought a copy of Office 2000 Pro on eBay. The seller asserted
that she is a student at Cal State, Fresno and had bought the software at
the campus bookstore as an academic version. I, being a professor at a
college in Bremerton WA, am qualifed to buy an academic version. However,
when I received the product and read the EULA, I learned that the CD should
have been marked "AV" or "Academic Version." Instead, the CD label said
"Not For Retail or OEM Distribution", which as best as I can tell, is
expressly reserved for resellers to use in demonstatrating the product to
customers. The EULA forbids the sale of these copies for any kind of
compensation. The CD label, and the label on the back of the sleeve say
"Unlicensed Software - Illegal without separate license from Microsoft."
Nevertheless, the label on the front of the sleeve seems to hint that it may
be an academic version (note the "AVTO" on line two):

Office Pro 2000sr1 Win32 English Disk Kit
MFG Reference: AVTO 07-31-03
Part Number: 269-04318

269-04318

I found it curious that when I installed the software, there were no
haragues to get you to register the software. And after installing, I
couldn't find any way to register the product. Shouldn't there have been
some automated way to register the product?

The sealed disk packet included two original holographic disks and an sr2
update disk. Is this really an academic version? And what about this
"separate license" the disks say I must have from Microsoft?

I am certain that these are genuine Microsoft disks. My questions are: Are
these disks an academic version, was the seller legal to sell them, and am I
legally qualified to use them?

Why not go to the bookstore on the campus where you work and compare it to what they have for sale.

I did, and it doesn't match. So I contacted Microsoft directly, and they
say that it is software sold to students under a volume licensing agreement
that precludes the student from transferring the software. It can only be
sold or used by a student or instructor at Cal State, Fresno. So... it
looks like I've been had.
