Is it legal to by a sealed copy of MS Office xp
Professional from services like eBay that contains the
holigram and license agreement that have not been opened,
installed and activated?

Explain, why. If it is still "as I mentioned below", what
makes this illegal from MS's point of view that a buyer
must beware?

It is not a question of legality. It may make MS angry or even violate their
policy to purchase a "grey market" copy of their S/W, but it's not "illegal".
I think what Chris is saying is that you may not get what you think you're
going to get from an eBay Seller. It is easy to re-shrink wrap an already
activated copy of, eg. XP Pro, which makes it essentially useless or it may be
an OEM copy which won't work on your machine.

Exactly as John stated, purchasing Microsoft Software on ebay is a buyer beware at best. Worst is that the software you buy is unusable...
