Office XP OEM question

Is it ok to sell a copy of office xp OEM if it was never
installed, opened or activated? I don't want to do
anything illegal, but I have three copies doing nothing
and I saw them for sale on ebay.

If they came with a major brand-name PC, (Dell, Gateway, HP, Compaq,
e-Machines, etc.) they are branded by the OEM and will not install on
another make/model of PC. If they were purchased as a bundle with new
hardware (such as a new motherboard), they are legally bound to that
hardware.

If you do sell OEM software, you, the seller, are legally responsible for
providing technical support to the purchaser of that software.

It is against eBay's AUP and TOS to sell OEM licences. The below is copied
directly from eBay's help: -

""OEM" or "bundled" copies of software may not be listed on eBay unless it
is being sold with computer hardware.

Definition
Original Equipment Manufacturer (OEM), or bundled software, is software that
is obtained as part of the purchase of a new computer. OEM software licenses
usually prohibit the purchaser from reselling the software without the
computer or, in some cases, without any computer hardware.

Warning
Listings offering OEM copies of software may be ended early by eBay.
Multiple violations of eBay's OEM Software policy could result in the
suspension of your account."
