OT - CanSpam?

At the risk of starting another slanging match, if somebody - based in the
US - were to be attempting to be using this newsgroup to drum up business,
then would they be violating the CAN-SPAM act? I don't know much about it
but doing a quick Google found me this:

"It requires that commercial email be identified as an advertisement and
include the sender's valid physical postal address. Your message must
contain clear and conspicuous notice that the message is an advertisement or
solicitation and that the recipient can opt out of receiving more commercial
email from you. It also must include your valid physical postal address."

Do newsgroup postings count as email? Can newsgroup viewers 'opt out'?

I doubt too many spammers would "include [their] valid physical postal
address"

Good thought, though!
