Save as... format warning

My default (in Excel->Prefs->Transition) is set to Excel 97-2002, X, etc
Everytime I Save as... a warning pops ups asking if I want to save it
int the Excel 97-2002 etc format.

It's damned annoying...how do I get rid of it permanently?
