Table of Contents and Protected Section

I have a Word document where the the first section (a form) is
protected and from that point on the document is unprotected. The TOC
falls into the unproctected area of the docutment, yet when I try
update the TOC I can't get access to it. Or if I try to access the TOC
via the menu, it is grayed out. Why is this so? How can I perform the
updates to the TOC without unprotecting the first section? Is this a
bug in Microsoft's Word application?
